Aviato Calendar Ventures, LLC (collectively, “Aviato”) the provider of the DaybookTM mobile application (the “Mobile App”) realizes that privacy is an important issue for those using mobile applications, and we take your privacy seriously. Please read the following to learn more about how we collect, use and safeguard the information you may provide to us via the Mobile App.  


This Privacy Statement is incorporated into and subject to the Aviato Terms of Use.  If you do not agree to the terms of this Privacy Statement, please do not provide us with any information and do not download the Mobile App. In this regard, please note that (1) the act of downloading the Mobile App signifies your acknowledgement that the Mobile App contains global positioning system (GPS) technology which will allow Aviato to know the physical location of your mobile device at all times (subject to carriers' cellular phone and data service coverage) and (2) by using the Mobile App and voluntarily providing your information to us, you consent to the collection and use of personally identifiable information as set forth in this Privacy Statement.

This Privacy Statement may be revised from time to time, and all such revisions shall be effective upon posting. Please revisit this page often to remain fully informed of our policies.


Via the Mobile App, Aviato collects from you the following personally identifiable information and other information:   

Downloading and Registering the Mobile App - At the time you download and register as a user of the Mobile App, you will be required to provide Aviato a username and your mobile device number, along with your approval of the Mobile App’s access to your device contacts, photographs, videos, calendars and GPS.

Automated Collection of Information - By downloading the Mobile App, Aviato will automatically log your mobile device identification number, and will have access to the contacts, photographs, videos and calendar information stored on your mobile device.  In addition, through the use of the Mobile App, so long as you do not disable the GPS capability, your mobile device will report to our servers your location (by longitude and latitude) upon opening the Mobile App.  Further, when you use the Mobile App and/or view and interact with our advertisements, Aviato will use automated information gathering tools, including cookies (small strings of text sent by the Mobile App and stored on your mobile device), which will allow us to record how you use the Mobile App, assess overall Mobile App activity, track interest in particular features of the Mobile App, provide you more relevant advertisements, administer the Mobile App, diagnose problems with our servers and troubleshoot technical concerns.  Similarly, we may request third party advertisers or other partners to serve advertisements or services to your mobile devices, which may use cookies or similar technologies placed by us or the third party.  We may also use server logs and log file entries for our internal marketing and demographic studies, so we can constantly improve the Mobile App.  Additionally, we may collect and store information (including personally identifiable information) locally on your mobile device using mechanisms such as browser web storage and application data caches.


Our Use of Information.  We collect, retain, and use your personally identifiable information for legitimate business purposes only, including without limitation the following: to provide the services offered via the Mobile App; to perform normal business operations, including automated delivery of updates to the Mobile App; to correspond with you regarding the Mobile App or matters relating to your use or potential use of the Mobile App; to operate or improve the Mobile App and/or our services; to inform you of developments in our company or about products or services we believe may be of interest to you; to monitor Mobile App visitor traffic patterns and Mobile App usage; to offer you more tailored content, including providing more relevant advertisements; to comply with applicable laws, regulations and rules, and requests of relevant law enforcement and/or other governmental agencies; to enforce our Terms of Use; and/or to protect the rights, property, or safety of Aviato, our users, and others.

Sharing Information.  We do not sell or rent your personally identifiable information to third parties. Aviato will not share, distribute or reference any information with third parties except as set forth in this Privacy Statement.  We share your information only with our affiliates and third parties providing services on our behalf.  We require our affiliates and third parties providing services on our behalf to limit their use and disclosure of your information to uses and disclosures that are consistent with this Privacy Statement, however, we cannot guarantee their compliance.  We may also share, in aggregate, statistical form, certain information (such as cookie data) regarding our users and Mobile App usage with our affiliates, service providers and third party advertisers to allow such parties to, among other things, deliver targeted advertisements that may be of interest to you. Information obtained from log files are also used internally for marketing purposes and/or demographic studies designed to help us improve and tailor the Mobile App.  Moreover, we will disclose information we maintain when required to do so by law or regulation, or in response to a request from a law enforcement or governmental agency or authority.

Further, neither your personal information nor the content you upload to the Mobile App will be made public via the Mobile App.  Such content will be accessible only to you and other users specifically designated by you, or as otherwise described in this Privacy Statement.  Accordingly, at your request, we will share your personal information with such designated users in connection with your use of certain syncing and sharing features and functionality of the Mobile App.


We strive to maintain the accuracy of any personally identifiable information that may be collected from you, and will use our commercially reasonable efforts to respond promptly to update our database when you tell us the information in our database is not accurate.  It is your responsibility to ensure that such information is accurate, complete and up-to-date.  You may obtain from us, by email, the information in our records.  If you wish to make any changes to any personally identifiable information you have provided to us, you may do so at any time by contacting us at  Information will be updated as soon as reasonably practicable. Please note, however, that removed information may persist in backup copies for a reasonable period of time but will not be generally available.

In compliance with the Children’s Online Privacy Protection Act, 15 U.S.C. §§ 6501-06 and 16 C.F.R. §§ 312.1-312.12, Aviato will not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to download the Mobile App. If you are under 13, please do not attempt to download the Mobile App or send any information about yourself to us, including your name, address, mobile device number, or email address. By downloading and using the Mobile App, you represent that you are not under 13 years of age.  


The Mobile App may reference or provide links to third party websites, services or products, including through third party advertisements. Aviato does not control and is not responsible for the third party websites or for the privacy policies or information practices of third parties or their websites. You should review the privacy policies applicable to such third party websites and services.


Because security is important to both Aviato and you, we will always make reasonable efforts to ensure the security of our systems.  Please be aware, however, that Internet data transmission is not always secure and we cannot warrant that information you transmit utilizing the Mobile App is secure.  


Aviato may, in the future, sell or otherwise transfer some or all of its assets to a third party.  Your information, including personally identifiable information and technical and usage information we obtain from you directly and automatically via the Mobile App, may be disclosed to any potential or actual third party purchasers of such assets and/or may be among those assets transferred.


When a user who is located in the European Union chooses to download and register for the Mobile App and make certain information available to Aviato, it is the user who is responsible for ensuring whether such actions and the sharing of information with Aviato through the Mobile App conforms to all EU local data protection laws. Aviato is not responsible under the EU local data protection laws for information obtained through the Mobile App.


This Privacy Statement is effective as of February 1, 2015.  We reserve the right, at any time, to modify, alter, or update this policy, and any such modifications, alterations, or updates will be effective upon posting.  In the event we modify this Privacy Statement, your continued use of the Mobile App will signify your acceptance of the modified Privacy Statement.
